Waste Collection Wembley Terms and Conditions

These Terms and Conditions set out the basis on which we provide waste collection services in Wembley and surrounding areas. By making a booking, using our website, or otherwise engaging our waste collection services, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order or allowing our team to attend your premises.

1. Definitions

In these Terms and Conditions, the following words have the meanings set out below:

Customer means the person, business, or organisation that requests or receives our waste collection services.

Services means any waste removal, collection, loading, transportation, and related services that we provide.

Waste means the items, materials, and rubbish presented by the Customer for collection, excluding any prohibited or hazardous items as set out in these Terms and Conditions.

Premises means the address or site from which we are requested to collect waste.

Agreement means the contract formed between us and the Customer when a booking is confirmed.

2. Scope of Services

We provide waste collection services for domestic and commercial customers in Wembley and nearby locations. Our services may include collection of general household waste, bulky items, garden waste, light construction and renovation waste, and commercial rubbish, subject to applicable regulations and our operational capacity.

We reserve the right to refuse collection of any items that are not in line with these Terms and Conditions, with our environmental obligations, or with applicable waste management laws. We may also refuse service where access is unsafe or where waste is not reasonably accessible.

3. Booking Process

3.1 Booking requests

Customers may request a booking by phone, email, or through our online enquiry or booking system where available. When making a booking request, you must provide accurate information, including your name, contact details, collection address, type and approximate volume or weight of waste, and any relevant access information.

3.2 Quotation

Based on the information you provide, we may give an estimated price or quotation. This estimate is given in good faith but is not binding if the actual nature or quantity of the waste differs from what was described, or if access conditions change. Final pricing will be confirmed on site before work begins wherever possible.

3.3 Confirmation of booking

Your booking is only confirmed when we have accepted your request and provided you with a booking confirmation, which may be communicated verbally, by email, or via another written form. We reserve the right to decline any booking request at our discretion.

3.4 Access and timing

We will make reasonable efforts to attend the Premises within the agreed time slot, but times are estimates only and may be affected by traffic, weather, operational issues, or other circumstances beyond our control. You must ensure we have safe, clear, and reasonable access to the Premises and to the waste to be collected during the agreed collection window.

4. Customer Obligations

The Customer agrees to:

Ensure that the person present at the Premises and interacting with our team has authority to authorise the waste to be removed and to agree any changes to the scope of work or price.

Provide clear instructions on which items are to be collected, and separate any items that must not be removed.

Ensure that waste is reasonably accessible, not excessively contaminated with soil or other extraneous material, and not obstructed by vehicles, locked gates, or other obstacles.

Comply with all applicable laws relating to the storage, presentation, and handling of waste, including any local regulations on waste segregation and recycling.

5. Waste Types and Prohibited Items

5.1 Acceptable waste

We typically accept general household and commercial waste, bulky items such as furniture and appliances, garden waste, and non-hazardous construction and renovation waste. All collections are subject to compliance with current waste and environmental regulations.

5.2 Prohibited and restricted items

We do not accept hazardous or highly regulated waste items unless expressly agreed in writing and in compliance with all legal requirements. Prohibited items include, without limitation:

Certain chemicals, solvents, oils, paints, and liquids.

Asbestos or materials suspected of containing asbestos.

Clinical, medical, or biological waste.

Gas cylinders, pressurised containers, or explosives.

Large quantities of electrical and electronic equipment where specialist disposal is required, unless pre-arranged.

Any other items that our team, acting reasonably, considers to pose a risk to health, safety, or the environment, or which we are not licensed or authorised to carry.

5.3 Incorrect description of waste

If the waste type, volume, or condition is materially different from what was described at the time of booking, we may adjust the price, change the collection method, or refuse to collect certain items. Where we refuse service because of such discrepancies, any applicable call-out or cancellation charges may still apply as detailed in these Terms and Conditions.

6. Pricing and Payment

6.1 Pricing structure

Our prices are based on factors such as the volume and weight of waste, type of materials, labour required, access difficulty, and disposal costs. Separate charges may apply for heavy or specialist items, additional labour time, or difficult access conditions.

6.2 VAT and other charges

All prices will be quoted inclusive or exclusive of VAT as stated at the time of quotation. Any additional fees or charges, such as parking costs or congestion charges incurred in performing the Services, may be added to the final invoice where applicable.

6.3 Payment terms

Unless otherwise agreed in writing, payment is due in full on completion of the collection and before our vehicle leaves the Premises. We may accept payment by cash, card, or bank transfer, subject to availability of these methods at the time of service. For commercial or account Customers, alternative payment terms may be agreed in writing.

6.4 Late payment

Where payment is not received by the due date, we may charge interest on overdue amounts at the statutory rate applicable under UK law. We may also suspend further services or withhold disposal documentation until payment has been received in full.

7. Cancellations and Amendments

7.1 Customer cancellations

If you wish to cancel or reschedule a booking, you must notify us as soon as reasonably possible. Where cancellation is received with sufficient notice before the scheduled collection time, we will not normally charge a cancellation fee. Where cancellation is received at short notice, we reserve the right to charge a reasonable call-out or cancellation fee to cover costs incurred.

7.2 Failure to provide access

If our team attends the Premises at the agreed time and is unable to gain access or is unable to safely perform the Services due to circumstances within the Customer's control, we may treat this as a late cancellation and apply a call-out charge. A new booking may be required, and additional charges may apply.

7.3 Amendments to bookings

Where you request changes to the booking, such as an increase in waste volume or a change of address, we will try to accommodate these changes but cannot guarantee that we will be able to do so. Revised prices or time slots may apply. Any material amendments must be confirmed by us to take effect.

7.4 Cancellations by us

We may cancel or reschedule a booking where it is not possible or safe to carry out the Services, including but not limited to vehicle breakdown, extreme weather, staff shortage, or regulatory constraints. In these circumstances, we will aim to provide as much notice as possible and offer a new appointment where feasible. We will not be liable for any indirect or consequential losses arising from such cancellations.

8. Performance of Services

Our team will exercise reasonable care and skill when performing the Services. We will load and remove waste from the Premises, subject to agreement on what is to be taken. You or your representative should be present during the collection to direct our team and confirm that only the intended items are removed.

We do not accept responsibility for items removed in error where the Customer has failed to clearly identify and separate items that should not be taken. Once waste has been loaded onto our vehicle, it may not be possible to retrieve specific items.

9. Liability and Limitations

9.1 General liability

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be lawfully excluded under UK law.

9.2 Exclusions and limitations

Subject to the above, our total liability to the Customer for any loss or damage arising out of or in connection with the Services, whether in contract, tort, or otherwise, shall be limited to the total price paid or payable for the relevant Services.

We are not liable for any loss of profit, revenue, business, contracts, anticipated savings, or for any indirect or consequential loss or damage, arising from or in connection with the performance or non-performance of the Services.

9.3 Damage to property

We will take reasonable care when carrying out the Services. However, the Customer acknowledges that damage may occur where waste is heavy, awkward, or located in confined spaces. The Customer is responsible for protecting floors, walls, driveways, and other surfaces. We will not be liable for minor cosmetic damage or pre-existing defects, or for damage that could not reasonably be avoided in carrying out the Services in accordance with your instructions.

10. Compliance with Waste Regulations

We operate in accordance with applicable UK waste management and environmental legislation. We will transport and dispose of collected waste only at authorised facilities and will take reasonable steps to maximise reuse and recycling where practicable.

By engaging our Services, the Customer confirms that they are authorised to transfer the waste to us and that the waste is not illegally dumped, stolen, or otherwise unlawfully obtained. The Customer agrees to provide any information reasonably requested to enable us to comply with our legal obligations, including requirements related to waste carrier documentation and duty of care obligations.

11. Complaints and Disputes

If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing full details of your concern. We will investigate the matter and aim to resolve it promptly and fairly. Where appropriate, we may offer a remedy such as a partial refund, re-attendance, or other corrective action, at our discretion.

12. Intellectual Property

All content, branding, and materials made available through our website or promotional materials, including text, logos, images, and designs, are owned or licensed by us. They may not be copied, reproduced, or used for any purpose without our prior written consent.

13. Data Protection and Privacy

We collect and process personal data in connection with our waste collection services, including contact details and service records. We will handle all personal data in accordance with applicable UK data protection legislation. We will use your information primarily to manage bookings, provide Services, process payments, and communicate with you. We may retain records for legal, accounting, and operational purposes. You have rights in relation to your personal information, including the right to access certain data we hold about you, subject to legal limitations.

14. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms and Conditions where such delay or failure is caused by an event or circumstance beyond our reasonable control, including but not limited to extreme weather, fire, flood, industrial disputes, power failures, pandemics, accidents, or actions by authorities.

15. Amendments to these Terms

We may update or amend these Terms and Conditions from time to time to reflect changes in law, operational practices, or services offered. The version in force at the time your booking is confirmed will apply to that booking. Updated terms may be made available on our website or on request.

16. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided, shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, subject to any mandatory rights you may have as a consumer to bring proceedings in your local jurisdiction.
